Whistleblower is a general term for a person who reports their knowledge of an illegal or fraudulent activity taking place in government departments, organizations, or companies. Whistleblowers can report information about a variety of activities, including corporate accounting fraud, false claims paid by the government, tax fraud, and others.

A whistleblower can be anyone with knowledge of an illegal activity taking place, including employees or former employees of a company, or someone who does business with the company. Whistleblowers are typically protected under various whistleblower laws from employer retaliation, and are often eligible for financial rewards.

Who can be a whistleblower?

A whistleblower is someone, in the private sector, who has inside knowledge about a private company’s fraud or other unlawful conduct. Whistleblowers have multiple options for reporting the unlawful conduct internally or externally. One avenue to report fraud externally is to file a qui tam lawsuit against the company. Anyone with material, non-public information about a private company defrauding the U.S. government can file a whistleblower claim under the federal False Claims Act.

What are False Claims?

What is a False Claim?

A “false claim” is a request for payment from the government for a product or service not actually provided. False claims typically involve large government spending programs, such as Medicare or national defense, where the government cannot realistically monitor every company requesting reimbursement.

What are Examples of False Claims

There are many examples of types of false claims that are paid by the government, including:

  • Doctors prescribing unnecessary treatments or medications in order to receive Medicare reimbursements
  • Defense contractors substituting less expensive parts in violation of a government contract
  • Pharmaceutical companies marketing drugs to doctors for off-label uses

What are False Claims Laws

Submitting false claims to the federal government is prohibited by the False Claims Act, a law passed by Congress in 1863 during the Civil War. The Act attempted to prevent companies supplying goods and services to the government from selling unusable products, such as faulty ammunition or spoiled rations.

Many states also have versions of the False Claims Act that prohibit companies from submitting false claims to state governments. In California, false claims are prohibited by the California False Claims Act.

What is the False Claims Act?

The False Claims Act or FCA is law passed by Congress which authorizes private citizens to sue private companies on the federal government’s behalf in order to recover money defrauded from the federal government. The FCA also creates triple liability (treble damages) for any company that knowingly defrauds the federal government by submitting a false claim for payment. The FCA’s definition of a “false claims” encompasses many things and has been expanded over time, but the most common example of a false claim is a bill submitted to the federal government by a government contractor which overstates how much money the contractor is entitled to
